Position Overview:

We are looking for a highly skilled Collections Restraint Specialist to oversee and manage sensitive or legally-complex collection accounts. This position requires a professional with experience in Merchant Cash Advance (MCA) or financial services, with strong knowledge of UCC filings, skip tracing, settlements, and legal procedures . The ideal candidate will work closely with legal, underwriting, and recovery teams to ensure compliant, strategic, and results-driven approaches on all restrained accounts.

Key Responsibilities:

• Manage accounts placed under restraint due to legal, reputational, or strategic sensitivity.
• Initiate and monitor UCC-1 filings , lien placements, and lien releases in collaboration with the legal team.
• Conduct and oversee skip tracing efforts using third-party databases and internal resources.
• Negotiate and structure settlements, workout plans, or restructured agreements with merchants in default or dispute.
• Maintain accurate records and ensure documentation supports all collection activities, settlements, and legal actions.
• Review and respond to legal correspondence, subpoenas, and enforcement-related documentation.
• Work with attorneys, collection agencies, and internal legal teams to ensure compliant case handling.
• Flag accounts that pose legal risks or require litigation referral.
• Prepare performance reports and risk assessments for restrained accounts.
• Ensure strict compliance with FDCPA, TCPA, UCC , and company policies.

Required Skills and Qualifications:

• Minimum 2–3 years of experience in collections, recovery, or legal collections , in MCA or alternative lending.
• Strong understanding of UCC filings and their enforcement in the context of default.
• Hands-on experience with skip tracing tools.
• Proficiency in negotiating payment arrangements , settlements, and forbearance agreements.
• Familiarity with legal collections documents such as judgments, liens, garnishments, and subpoenas.
• Excellent verbal and written communication, especially in handling sensitive or escalated situations.
• Highly organized with attention to detail and experience managing high-risk accounts.

Preferred Qualifications:

• Background in Merchant Cash Advance.
